Terms of Service

1. What LYSTNG is

LYSTNG is a platform for real estate businesses. You can build websites and listings hosted on lystng.com subdomains, capture leads through those sites, run and manage advertising campaigns on Google, Meta and WhatsApp, access the leads those campaigns generate, and create images and content using AI features.

2. Definitions

• Services means the LYSTNG platform and all related features.
• Your Site means any website, subdomain, listing or content you create or publish using LYSTNG.
• End Users means the visitors, leads and contacts who interact with Your Site or your campaigns.
• Connected Platform means any third-party account you link, such as Google, Meta or WhatsApp, and “Platform Terms” means that platform's own terms and policies.
• Authorized Actions means operations that create, edit, pause or manage campaigns, ads and messages on a Connected Platform on your behalf.

3. Eligibility and accounts

You must be at least 18 and able to enter a contract, and you must accept these Terms on behalf of your business and be authorized to do so. You are responsible for your login credentials and for all activity under your account, and must notify us of any unauthorized use.

4. Your Site, your content and your End Users

You are solely responsible for Your Site, including its listings, content, images and any claims it makes, and for your relationship with your End Users. You must have all rights and permissions needed for the content you publish, and you must comply with all laws that apply to your business, including real estate, advertising, consumer-protection and data-protection laws.

You are the controller of the personal data you collect from your End Users through Your Site, your lead forms and your campaigns. You are responsible for providing your End Users with an appropriate privacy notice, for having a lawful basis to collect and use their data, and for obtaining any consent required. As a convenience, LYSTNG provides a default privacy notice and cookie behavior for sites built on LYSTNG subdomains, but you remain responsible for ensuring it is accurate and sufficient for your business. LYSTNG acts as your processor for this data under our Data Processing Agreement.

You must not use LYSTNG to publish or process content that is unlawful, infringing, deceptive, discriminatory or harmful, or to collect sensitive personal data without a proper legal basis.

5. Connecting platforms

To run campaigns you link Connected Platforms through authorization flows such as OAuth. You represent that you have authority to link each account and grant the permissions requested. Your use of each Connected Platform remains governed by its own Platform Terms, including:

• Meta Platform Terms and the WhatsApp Business Messaging Policy
• Google APIs Terms of Service and Google Ads Terms

You agree to comply with all applicable Platform Terms. Where you instruct LYSTNG to carry out Authorized Actions, you are responsible for the campaigns, budgets, targeting, creative and messages you approve.

6. WhatsApp

Where you connect WhatsApp, you authorize LYSTNG to access and manage your WhatsApp Business Account to provide the WhatsApp features you use, which currently include Click-to-WhatsApp ads and messaging and may expand to related features such as product catalogue syncing. You are responsible for obtaining any opt-in required before you message a person, for using approved message templates where required, and for complying with the WhatsApp Business Messaging Policy and applicable law. LYSTNG is not responsible for the messages you send or the conversations you conduct.

7. Leads and campaign data

Where you access leads generated through Your Site, Meta Lead Ads, Google Lead Forms or WhatsApp, you are responsible for handling those leads lawfully, including any consent, notice and marketing rules that apply. LYSTNG processes this data on your behalf as your processor under the Data Processing Agreement. You must not use the platform to acquire or process personal data you are not authorized to hold.

8. AI features

LYSTNG offers AI features powered by third-party model providers. These currently include image and content generation and may expand to other AI-assisted features over time. Subject to the provider's terms and applicable law, you own the outputs you generate, and you are responsible for reviewing them and for using them lawfully, including not infringing intellectual property or using a person's likeness without rights to do so. AI outputs may be inaccurate or unsuitable, are provided without warranty, and must not be relied on as professional advice. Neither we nor the providers use your inputs or outputs to train generalized AI models.

9. Advertising spend

Fees for LYSTNG cover access to the platform only. They do not include advertising spend, which you pay directly to Google, Meta or the relevant platform. You are solely responsible for all advertising costs and for any billing disputes with the platforms. LYSTNG does not guarantee any advertising outcome or result.

10. Pricing and payment

Fees are set out on our pricing page and are exclusive of taxes unless stated. We accept payment through third-party payment processors. We may change fees on reasonable notice. Fees are non-refundable except where required by law or expressly stated.

11. Acceptable use

You agree not to: use the Services unlawfully; probe, scan or test the security of our systems; interfere with or disrupt the Services; reverse engineer or extract our source code; share credentials with unauthorized parties; resell or provide the Services to third parties except your own authorized users; or use the Services to build a competing product.

12. Intellectual property

The Services and all related intellectual property remain our exclusive property. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Services for your business. Your content and Your Site remain yours, and you grant us a limited license to host and process them only to provide the Services.

13. Data protection

Our handling of personal data is described in our Privacy Policy, and our processing of the personal data you control is governed by our Data Processing Agreement, both of which form part of these Terms.

14. Disclaimers

The Services are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or secure, and their availability depends on third-party platforms that may change.

15. Limitation of liability

To the maximum extent permitted by law, LYSTNG will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to the Services will not exceed the greater of the fees you paid to LYSTNG in the three months before the event giving rise to the claim, or one hundred United States dollars.

16. Indemnity

You agree to indemnify and hold harmless LYSTNG and its officers, directors, employees and agents from any claims, losses, damages and expenses, including reasonable legal fees, arising from Your Site or its content, your handling of End User or lead data, any claim by your End Users, any Authorized Action or message you approved, your AI-generated content, your breach of these Terms or any Platform Terms, or any decision by a platform regarding your account.

17. Suspension and termination

You may stop using the Services and close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms or any Platform Terms, or to protect the Services or others. On termination your right to use the Services ends, and we will delete or return your data as described in the Privacy Policy and Data Processing Agreement. Provisions that by their nature survive termination, including intellectual property, disclaimers, liability and indemnity, will survive.

18. Changes

We may modify these Terms from time to time. We will post the updated Terms and, where changes are material, notify you. Material changes take effect 30 days after posting, and continued use after that means you accept them.

19. Governing law and jurisdiction

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute is subject to the exclusive jurisdiction of the courts of Pune, Maharashtra, India.
